Raleigh, NC (August 1, 2016) - The family of a 15-year-old Morrisville girl who was killed in an automobile accident filed suit today against the estate of a dump truck driver saying his negligent operation of the vehicle led to her death.
Laura Yost, a Panther Creek High sophomore, was injured on Sept. 16, 2014, while she and her older brother Ryan were being driven to school by a family friend.
The lawsuit, filed in Wake County Superior Court by Laura and Ryan’s parents, names the Estate of Jerry Middleton as a defendant. Laura was struck when the fully loaded dump truck driven by Middleton struck the passenger side of the vehicle. The suit alleges that Middleton failed to keep a proper lookout, failed to maintain his vehicle under control, improperly proceeded into the intersection, failed to follow the rules of the road and endangered the lives of others. The suit was filed by attorney Adam Neijna, of the Law Offices of Adam Neijna, in Raleigh.
“What happened to Laura and Ryan could just as easily have happened to other children,” Neijna said. “We need to make sure our children are safe on their way to school and that truck drivers recognize the inherent dangers when they operate these massive vehicles so that tragedies such as this never happen again.”
Laura and Ryan, both of whom were injured, were transported to the hospital under trauma status. Laura was diagnosed with a traumatic brain injury. Despite significant medical interventions intended to save her life, Laura died on September 23, 2014. Laura is the daughter of Tim and Brenda Yost.
